Early Registration IBM Upload Virtual Summit 2008 Competition

  1. Information on how to enter this competition and prize details form part of these conditions of entry. By submitting a registration, entrants accept these conditions of entry.
  2. The Promoter is IBM Australia Ltd of 601 Pacific Highway, St Leonard's, NSW, 2065, ABN 79 000 024 733.
  3. Entry is only open to Australian and New Zealand residents aged 18 years or older. Employees of the Promoter, of participating outlets and of the agencies associated with this promotion (including the immediate family members of those employees) are ineligible to enter.
  4. The promotion commences 12am AEST on or by 07 July 2008 and closes 12am AEST on or by 31st July 2008 or once all prizes have been awarded, which is earlier.
  5. To enter and be eligible to receive a prize, an Eligible Entrant must, during the Promotion Period be one of the first 400 entrants to fully complete and submit a registration form to sign-up to the IBM Upload Virtual Summit 2008. The registration form may be accessed by clicking on the link provided in the email from IBM or via the web address <http://www.ibmupload.com>. Once all of the fields in the registration form have been answered, the Eligible Entrant must click on the "submit" button in order to submit the form to IBM. The promoter accepts no responsibility for late, lost, incomplete, illegible or misdirected entries.
  6. This is a game of skill and chance plays no part in determining the winner.
  7. Only one entry per Eligible Entrant will be accepted.
  8. Incomplete, indecipherable, or illegible entries will be deemed invalid.
  9. Entries submitted in conjunction with any other promotion of the Promoter will be invalid.
  10. The Promoter accepts no responsibility for late entries or entries not received for any reason. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
  11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of work) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions of Entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  12. The Promoter's decision in relation to any aspect of the Promotion is final and binding on each person who enters and no correspondence will be entered into.
  13. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  14. The first 400 Eligible Entrants to submit a fully completed registration form to sign-up to the IBM Upload Virtual Summit 2008 will win a Prize. There is a total of 400 Prizes to be won.
  15. Prizes will be awarded on a "first come, first served" basis subject to availability of each prize while stocks last. Eligible entrants who qualify for a Prize will receive Stereo Retractable Ear Phones, valued at AUD$9.30 including GST.
  16. Prize values are correct as at 03 July 2008.
  17. The winners will be notified by email in 72 hours from their successful entry, and the prize will be sent using the details of their registration form.
  18. Prizes are strictly limited while stocks last or until the end of the Promotion Period, whichever occurs first. Once the total quantity of prizes has been claimed, that prize will no longer be available and any subsequent entrants will not be eligible to receive a prize.
  19. In the event that any Prize has not been claimed by 1 December 2008, the Promoter reserves the right to select another winner, subject to any written directions given by the relevant State or Territory lotteries department.
  20. Total value of the prize pool is AUD$3720 including GST.
  21. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
  22. Any ancillary costs associated with redeeming the prizes are not included. Any unused balance of prizes will not be awarded as cash.
  23. Redemption of the prizes are subject to any terms and conditions of the issuer including those specified on the prize.
  24. Entrants need to look to third party issuers for all other warranties and conditions of use.
  25. If any prize or reward (or part of any prize or reward) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize or reward (or that part of the prize or reward) with a prize or reward to the equal value and/or specification, subject to any written directions from State or Territory lotteries department.
  26. Prizes and rewards, or any unused portion of a prize or rewards, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified in these Terms and Conditions of Entry.
  27. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) subject to any written directions from a State or Territory lotteries department, to modify, suspend, terminate or cancel the promotion, as appropriate.
  28. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  29. Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize or reward) is the sole responsibility of the entrant. Entrants should seek independent financial advice in this regard.
  30. To the extent permitted by law, the Promoter will not be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with this Promotion or as a result of accepting or using any of the prizes.
  31. All entries become the property of the Promoter. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize/reward suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. All entries will be entered into a database and the Promoter may use the information for promotional, marketing or publicity purposes including sending electronic messages unless otherwise advised by the entrant by calling the Promoter on 132 426. Entrants can request access to or correction of their details by contacting the Promoter on 132 426. Entrants should direct any request to access, update or correct information to the Promoter.
  32. The laws of Australia and New Zealand apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia for Australian residents, and the courts of New Zealand for New Zealand residents.
