IBM® Click Magazine Competition ("Promotion") Terms and Conditions

  1. Information on how to enter this Promotion and prize details form part of these Terms and Conditions of entry.
  2. The promoter is IBM Australia Limited ABN 79 000 024 733, Level 13, 601 Pacific Highway, St Leonards, Sydney, NSW, 2065 ("Promoter").
  3. The Promotion will run from midnight 30 September 2011 through to midnight Monday the 9 December 2011 AEDST.
  4. To enter the Promotion and be eligible to win, entrants must submit a fully completed registration form online at ibm.com/businesscenter/au/click and answer the question on the registration form “Tell us in 25 words or less: Which Click magazine article was most relevant to you and why?” by midnight 9 December 2011. Entrants must also opt-in to IBM.com communications (“Eligible Entry”)
  5. Entry is only open to Australian residents over the age of 18 years who submit a fully completed registration form (including answering the question), ("Eligible Entrants").
  6. Incomplete, illegible, indecipherable and applications submitted after 12:00 am 9 December 2011 are invalid.
  7. Employees, management and contractors of the Promoter and companies associated with this Promotion (including their immediate families) are ineligible to enter.
  8. The Eligible Entry judged by the Promoter to be the most creative at Level 3 601 Pacific Highway St Leonards NSW 2065 at 9am AEDST on 12 December 2011 will win the Prize.
  9. The winner will be notified via phone and email by 14 December 2011 and the winner will be required to provide IBM with an Australian postal address. The Prize will be delivered to the winner's Australian address within 28 days of the Event. The Prize will only be delivered to an address in Australia.
  10. The winner’s name will be published online at www.ibm.com/events/au/announcements by 14 December 2011.
  11. The prize is an Apple iPad2 16GB + Wi-Fi + 3G valued at RRP $729.00 (incl GST) ("Prize").
  12. Only 1 entry per person is permitted.
  13. The Prize is not transferrable and cannot be exchanged for cash. In the event that the Promoter is unable to supply the Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value.
  14. All entries become the property of the Promoter. All entries will be entered into a database and the Promoter may use entrants’ names and addresses for future marketing or sales follow up, unless otherwise advised by the entrant on the entry form or by the entrant calling IBM on 132 426. Entrants can request access to or correction of their details by contacting the Promoter on 132 426.
  15. The Promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained in connection with this competition or as a result of accepting or using the prize, except for any liability which cannot be excluded by law.
  16. IBM offers no advice and accepts no taxation liability arising from or in connection with the prizes offered under the promotion. Any taxation liability arising from winning the prize is the responsibility of the prize winner or their employer.
  17. The judge’s decision is final on all matters and no correspondence will be entered into. Entry into this competition will be deemed to be an acceptance of the above terms and conditions.
  18. Should the winner be unable to accept the prize due to employment regulations, they will be offered the opportunity to direct IBM to donate the Prize directly to a charity of their choice on the winner's behalf. If the winner decides to relinquish the Prize, the Promoter judges will judge the second most creative Eligible Entry within two weeks of the first winner notifying them of the decision to relinquish the Prize as the winner of the Prize and will notify this winner within two business days of the judging.
